DuPage County State's Attorney Announcement on
Off-Duty Police Officer Shooting Incident

West Chicago, Illinois: April 20, 2012 - DuPage County State's Attorney, Robert Berlin, announced that after a thorough investigation by the DuPage County Sheriff's Office and the States Attorney's Office he will not be pursuing criminal charges against the West Chicago Police Officer involved in an off-duty shooting incident which took place on February 18, 2012 after midnight.
The shooting occurred following a hit and run accident witnessed by the Officer. One of the occupants in the vehicle was injured as the result of the shooting. State's Attorney Berlin determined that, due to the conflicting witness statements, that his Office would not be able to meet their burden of proof and, therefore, criminal charges would not be filed against the Officer.
West Chicago Police Chief Laz Perez announced that his Department would utilize the independent investigation conducted by the Sheriff's Office and the States Attorney's Office to determine whether disciplinary action will be pursued against the Officer as a result of his off-duty conduct. Until the West Chicago Police Department internal investigation is completed, no further details will be released. The Officer has been on administrative leave since the day of the incident and will remain so pending the conclusion of the investigation.
